Force Majeure & Limitation of Liability

FS-Blommé shall not be held liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control ("Force Majeure Event").

A Force Majeure Event includes, but is not limited to:

• Acts of God, flood, fire, or earthquake;

• War, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest; * Government order, law, or actions;

• Embargoes or blockades in effect on or after the date of this Agreement;

• National or regional emergency;

• Strikes, labor stoppages or slowdowns, or other industrial disturbances; and

• Shortage of adequate power or transportation facilities.

In the event of a Force Majeure Event—specifically including situations of war or international conflict—our performance is deemed to be suspended for the period that the event continues.

FS-Blommé cannot be held accountable or liable for any financial losses or situations where a refund may become impossible due to the disruption of banking systems, international sanctions, or the total suspension of logistics services resulting from such events. We will, however, use our reasonable endeavors to bring the Force Majeure Event to a close or to find a solution by which our obligations may be performed despite the event, where legally and practically possible.

Non-Refundable Charitable Donations

Please note that for certain products or promotions where a portion of the purchase price is designated for donation to a charitable organization, the donated portion of the payment is non-refundable. In the event of a return or refund for such an item, you will be refunded the purchase price minus the specific amount that has already been committed or transferred to the charitable cause. FS-Blommé cannot be held liable for, or required to recover, funds once they have been distributed to third-party non-profit organizations.
